1 General
1-1 In these general terms and conditions, "Aquadefender BV" means the company registered under Chamber of Commerce No: 91970997 and further referred to as Aquadefender BV. Client or customer means the potential purchaser of goods, services, and/or products.
1-2 These general terms and conditions apply to all legal acts of, as well as to agreements concluded between Aquadefender BV and the client, regardless of the residence or place of business of the parties involved in that agreement and regardless of the place where that agreement was concluded or is to be executed.
1-3 Deviations from these general terms and conditions are only valid if expressly agreed upon in writing.
1-4 Client terms only apply if and to the extent that written agreement has been reached with Aquadefender BV.
1-5 By placing your order through our online shop www.aquadefender.nl, you acknowledge that you agree to the delivery and payment terms and conditions. Aquadefender BV reserves the right to change its delivery and/or payment terms after the expiration of the term.

3 Returns, refunds, and shipping
3-1 If the product is not satisfactory, you have the legal period of 30 days to return the product. To qualify for a refund, the product must be in its original packaging and a payment confirmation must be included.
3-2 As soon as we have received the product, we will inspect it and immediately inform you of the status of your refund. If your return is approved, we will initiate a refund via the original payment method.
3-3 The shipping costs for returning a product are at our own expense.
3-4 The customer is personally responsible for the return shipment. The shipping risk is borne by the sender. Aquadefender is therefore not liable for lost orders that have been sent to us by the customer themselves.
3-5 On www.aquadefender.nl/pages/retourneren you will find the return address, return procedure, and can download the return form.
4 Conclusion of purchase agreement
4-1 If the offered items are not returned within the statutory period in the manner designated by Aquadefender, the purchase agreement is deemed to have been concluded on the day following the expiration of the 14-day viewing period.
4-2 The agreement takes effect on the day the order is confirmed in writing by Aquadefender BV.
5 Offers
5-1 All offers made by us, in any form whatsoever, are free of charge unless explicitly stated otherwise.
5-2 Transfer of offers and/or other documentation does not oblige us to accept an order.
5-3 Promotional offers are not valid in combination with other promotional offers.
6 Acceptance of orders
6-1 Regardless of the payment method chosen by the customer when ordering, Aquadefender BV reserves the right not to execute orders or to execute them at a later time.
6-2 Items that Aquadefender BV has in stock are usually shipped the same or next working day.
6-3 If items are not in stock, the customer has the right to cancel the order.
7 Transport risk
7-1 Aquadefender BV is not responsible for the loss of orders shipped via PostNL, UPS, DHL, DPD, or De Post (BE/DE) or any other carrier.
7-2 By placing the order, you accept the carrier chosen by us (PostNL in almost all cases) and thus also the terms of the respective carrier.
7-3 Loss or misplacement of a shipment after it has been demonstrably handed over by Aquadefender BV to the respective carrier is always the customer's responsibility.
8 Delivery
8-1 Delivery is made based on the payment method chosen by the customer.
8-2 If an order is shipped via PostNL, UPS, or De Post (BE), these costs will be charged as part of the total delivery costs.
8-3 Offered items remain the property of Aquadefender BV until the full outstanding amount for these goods has been paid by the customer.
8-4 The delivery time stated by Aquadefender BV can never be considered a strict deadline. Exceeding the delivery time can never lead to compensation or any other action against Aquadefender BV, unless otherwise agreed in writing.
8-5 Aquadefender BV reserves the right to deliver and invoice ordered goods in partial shipments.
8-6 If the client does not provide the necessary cooperation to fulfill the obligation, Aquadefender BV is entitled to terminate the agreement within 8 days after the client has been notified of default, without requiring judicial intervention.
8-7 Force majeure is understood as a failure that cannot be attributed to Aquadefender BV, including business disruptions, delayed supply by suppliers, and transport difficulties.
8-8 During the period of force majeure, Aquadefender BV’s obligations are suspended. If the period lasts longer than 30 days, both parties are entitled to terminate the agreement without any obligation to pay damages.
8-9 If Aquadefender BV can partially fulfill its obligations at the onset of force majeure, it is entitled to invoice the part already delivered separately.
9 Liability
9-1 Aquadefender BV excludes all liability, except as required by law. Our liability never exceeds the total amount of the order.
9-2 Aquadefender BV is never liable for damage caused by correct or incorrect assembly by the consumer or a third party designated by the consumer.
9-3 The total liability of Aquadefender BV for damage due to death or bodily injury is limited to the amount paid out by its insurance company.
9-4 Liability for indirect damage, including consequential damage, lost profits, missed savings, and immaterial damage, is excluded.
9-5 Any legal claims regarding damages expire within twelve months after the damage is discovered.
9-6 All disputes shall initially be submitted exclusively to the competent court in the district of Aquadefender BV.
10 Payment
10-1 If the customer has chosen to pay in advance by bank transfer, the ordered items must be paid within 14 days. After receipt of payment, the customer will receive a confirmation email and Aquadefender BV will start the delivery process.
10-2 All prices are (unless otherwise stated) in Euros including VAT. Delivery costs are exclusive unless explicitly stated otherwise.
10-3 Aquadefender BV reserves the right to change its prices and rates. In this case, the customer is entitled to cancel an order within 7 days after notification.
10-4 If cost-increasing circumstances occur during the term of the agreement beyond the control of Aquadefender BV, the client agrees to a price change.
10-5 If the customer remains negligent in payment, the balance will be increased by extrajudicial costs of 15% of the outstanding balance, as well as €25 in administration fees and interest.
10-6 All (extra)judicial costs related to collection will be fully charged to the customer.
11 Personal data registration / Privacy statement
11-1 By placing an order, data is processed in the customer database of Aquadefender.nl for business operations, order processing, customer management, and sending own offers.
11-2 Upon written request from the customer, the stored personal data will be made available for inspection. Any corrections will be processed in the registration.
11-3 The processing of personal data is carried out in accordance with applicable laws and regulations.
11-4 If you do not wish to receive advertising by mail or email, you can indicate this via the link at the bottom of each newsletter or in your own account.
11-5 Aquadefender BV will under no circumstances provide data to third parties that could compromise the customer's privacy.
12 Other provisions
12-1 Aquadefender BV can never accept liability for the consequences of layout, typing, and/or programming errors.
12-2 By placing an order, every customer unconditionally agrees to all sales terms as stated in this document.
12-3 Only Dutch law applies to these sales conditions.
12-4 The general terms and conditions of Aquadefender BV are subject to Dutch law for "distance selling."
13 Delivery without VAT
Companies outside the Netherlands but within the EU can receive their order excluding VAT. Please send us your VAT number along with full address details. Companies and private individuals outside the EU can order excluding VAT. For more information: info@aquadefender.nl.
